This Privacy Policy (hereinafter by the “Policy”) describes how Eshtarena (hereinafter by “we”, “our”, “us”, the “Company”, the “Operator” or the “Controller”) process and controls Personal Data (i.e., as defined below), how we keep it safe and secure, and how you opt out of our data collection, while your visit or use of our platform eshtarena.com (hereinafter by the “Platform”).

We have made this Policy in accordance with the General Data Protection Regulation (hereinafter by the “GDPR”), and the Egyptian Data Protection Code no. 151 for the year 2020 (hereinafter by the “EDPC”) (the GDPR and the EDPC are referred to collectively hereinafter by the “Data Protection Law” or “DPL”).

We refer to the Platform users and/or visitors hereinafter by second-person pronouns (i.e., you, your, yours, yourself, or yourselves).

You hereby, declare, accept, acknowledge, comprehend, and agree to the provisions stated herein, in this Policy, as updated, and you shall not have any rights except for the rights explicitly granted to you by this Policy or the DPL.

The term “Services” as may appear in this Policy shall have the meaning ascribed to it in the Terms and Conditions.

By using any of the services provided by the Platform or you are just visiting the Platform, you are considered aware of all terms stated herein, in this Policy, and you shall be deemed explicitly accepting the terms and provisions stated herein.

You hereby, declare that you shall abide with the provisions stated herein, in this Policy, as updated, and should you have any doubts you may contact us, or you may opt out.

For the purpose of clarification and interpretation, the term Personal Data shall mean (IN GENERAL), any personally identifiable information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. (“Personal Data”)

During your usage and visit of the Platform we may collect the following:

(i) Identity Data: first name, maiden name, nationality, language spoken, personal photo, email address, mobile number.

(ii) Technical Data: login data, mobile software type and version, and/or operating system.

(iii) Geolocation Data: time zone setting, location, address, IP address and/or postal code.

(iv) Data Provided by you: you may while using the Platform provide us with any other Personal Data.

As a SaaS based Platform, we may use your Personal Data for the following:

It's important to note that we will only use your Personal Data for legitimate business purposes and in accordance with the DPL.

(i) Provide Services: We may use your Personal Data to provide you the Platform and its features. Moreover, to analyze how you use the Platform in order to give you a premium experience.

(iii) Personalization: We may use your Personal Data to personalize your experience on the Platform, along-with providing customized content based on your preferences.

(iv) Provide Troubleshoot: We may use your Personal Data to provide functionality, analyze performance, fix errors, and improve the usability and effectiveness of the Services.

(v) Research and Development: We may also use your Personal Data for research and development purposes, as part of these activities, we may generate aggregated, unidentified data that we collect, we may use this anonymous data and share it with third parties for our lawful business purposes to analyze, improve and develop the Platform.

(vi) Marketing: We may use your Personal Data to market and advertise for our services to other users. This may include sending promotional emails or displaying targeted ads on the Platform or other websites.

Your Personal Data privacy is an important part of our business, and we are not in the business of selling our users' personal data to others. However, we may share your personal data with third parties including the following:

(i) Payment Processors: We may share your Personal Data with third-party payment facilitators, aggregators and/or processors to act as a payment gateway and process payment to our services provided via the Platform.

(ii) Cloud Hosts: We may share your Personal Data with third-party cloud storage space providers to help us manage and store your Personal Data.

(iii) Legal and Regulatory Authorities: We may share your Personal Data with any law enforcement authority as the case may be, as required and in order to comply with the DPL.

We work to protect the security of your Personal Data during transmission by using encryption protocols and software. Moreover, we maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of your Personal Data. Our security procedures mean that we may occasionally request proof of identity before we disclose Personal Data to you.

It is important for you to protect against unauthorized access to your password and to your computer, devices, and applications.

You have the right to opt-out of certain uses of your Personal Data. Specifically, you may opt-out of receiving marketing communications from us by following the instructions provided in each marketing email or by contacting us.

The Right to be Forgotten: You may also request that we delete your Personal Data by contacting us using the contact information provided below. Please note that we may not be able to delete your Personal Data if we are required to retain it by law or for legitimate business purposes.

If you are under the age of 18, or if you are considered as a Child according to the DPL or the governing law of your state you shall not use the Platform and you shall not disclose, provide us with any of your Personal Data.

We use cookies and other tracking technologies to collect information about your use of the Platform.

Cookies are small text files that are stored on your device when you use and visit the Platform. It allows us to remember your preferences and to improve your user experience. In general, there are many types of cookies such as, Session cookies (e.g., performance cookies) and Persistent cookies (e.g., settings cookies).

We use both session cookies and persistent cookies on the Platform. (i) Session cookies are temporary and are deleted when the session is ended, while (ii) Persistent cookies remain on your device until they expire or until you decide to delete them.

We may amend the provisions contained in this Policy when as we consider appropriate. Should we do so, we will notify you by various procedures through the Platform (e.g., through a banner, a pop-up or a push notification), or we may send you a notice via your e-mail address when the change in question may affect your Personal Data processing, for you to be able to review the changes, assess them, as the case may be. In any case, we suggest you review this Policy from time to time in case minor changes are made or that we make any interactive improvement, taking the opportunity that you will always find it as a permanent point of information on the Platform.
